These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Client," or "Visitor") and Mindful Mage Counselling ("we," "our," "us"), regarding your access and use of our website, counselling services, digital platforms (e.g., YouTube, Rumble, Twitch), and all other related services and content we provide (collectively, the "Services"). By using our website or engaging in our services, you agree to be bound by these Terms and our Privacy Policy.

1. Terms of Use Agreement

By accessing this website or any platform operated by Mindful Mage Counselling, you agree to these Terms and Conditions of Use. These Terms constitute a binding agreement and apply to all users. Any content you submit via contact forms, emails, media platforms, or otherwise becomes the intellectual property of Mindful Mage Counselling, unless explicitly stated otherwise. If you do not acknowledge and agree to these Terms of Use, then do not enter your information and do not continue using our Sites. Your access to and use of the Sites is subject to these Terms of Use and all applicable laws.

These Terms may be updated periodically without notice. The latest version will always be available on our website. Continued use of our services implies acceptance of the current version.

2. Privacy and Data Security

Your privacy is governed by our Privacy Policy, which outlines how we collect, use, and protect your data in compliance with Alberta’s Personal Information Protection Act (PIPA) and Health Information Act (HIA). Although data is transmitted through secure channels, no digital transmission is guaranteed to be completely secure. You acknowledge and accept this risk.

3. Age Restrictions

Mindful Mage Counselling does not intentionally target anyone under the age of 16. Our Sites and services are not directed toward people under the age of 16, nor do we knowingly collect information from individuals under the age of 16. Individuals between the ages of 16 and 18 are granted permission to use our Sites only with the permission of their parent or guardian.

4. Eligibility and Scope of Practice

Mindful Mage Counselling offers services only to residents of Alberta, Canada, unless otherwise regulated. We do not diagnose medical or psychiatric conditions or prescribe medications. Mindful Mage Counselling’s Services are not a substitute for crisis intervention.

5. Content, Copyright and Trademark

All materials on our platforms—including but not limited to text, graphics, photographs, session resources, logos, audio content, livestream footage, digital downloads, proprietary frameworks, trademarks, and code (collectively, “Content”)—are owned by or licensed to Mindful Mage Counselling and are protected by Canadian and international copyright, trademark, and intellectual property laws.

Except as expressly permitted, you may not copy, reproduce, republish, download, upload, post, transmit, distribute, or modify any part of this Site or Services in any form. You are granted a limited license to access and view the Content for personal, non-commercial use only. Any unauthorized use of the Content or violation of this clause may result in legal action.

Any feedback, comments, or materials you submit to us—whether via email, website form, livestream chat, or direct message—becomes the property of Mindful Mage Counselling, with a worldwide, royalty-free, perpetual license to use, reproduce, modify, publish, or distribute it unless explicitly stated otherwise.

The information and services provided by Mindful Mage Counselling are offered on an “AS IS” and “AS AVAILABLE” basis. No warranties, guarantees, or representations of any kind, express or implied, are made regarding:

• The security or error-free nature of communications, including email and video calls;
• The safety or fitness for any specific purpose.

We disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose. No guarantee is made regarding the results of using our Services, including counselling sessions, livestreams, or media content.

Any educational content provided through YouTube, Twitch, Rumble, or other media platforms is not clinical advice and should not be interpreted as therapy. You agree to take 100% responsibility for your interpretation and application of all such content.

7. Limitation of Liability

To the fullest extent permitted by law, Mindful Mage Counselling and its directors, employees, contractors, representatives, licensors, and affiliates will not be held liable for any direct, indirect, incidental, special, punitive, or consequential damages—including but not limited to loss of profits, emotional distress, reputational harm, loss of data, or third-party claims—arising out of or related to:

• Your use or inability to use the Site or Services;
• Unauthorized access to or alteration of your transmissions or data;
• Statements or conduct of any third party;
• Any errors, inaccuracies, or omissions in content.

This limitation applies whether the alleged liability is based in contract, negligence, tort, strict liability, or any other legal theory. You accept full responsibility for any actions taken based on information received through our Services, and you agree that such actions are done at your own risk.

8. User Conduct and Restrictions

You agree to use the Site and Services only for lawful purposes and in compliance with all applicable local, national, and international laws. You must not:

• If any part of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• No waiver of any breach or default shall be deemed a waiver of any subsequent breach or default.
• These Terms constitute the entire agreement between you and Mindful Mage Counselling.
